Police were looking for a runaway 13 year old girl and got intelligence she was living in danger with a man in his 30's who had a long criminal record and her life was in danger. They found her at the home of this man and she was flicking her cigarette lighter when police asked her what she was doing with it. She told them she uses it to light her cigarettes. They asked her to hand it to them but she refused telling them she was not smoking in a public place. The teenager directed them to a New South Wales government website and allowed her to keep her ciggies. They then took her home to her mother. Can you smoke at 16 in NSW? It is not an offence for a person under 18 to possess or use tobacco cigarettes.
